What is GDPR?
The General Data Protection Regulation (GDPR) (Regulation (EU) 2016/679) is a regulation by which the European Parliament, the Council of the European Union and the European Commission intend to strengthen and unify data protection for all individuals within the European Union (EU)
When do you have to comply?
You have until May 2018 to make sure that your organisation complies with the GDP Regulations. So far, we have yet to meet a company that is actually ready!
Does GDPR apply to you?
If you store or process any customer data and you're based in the UK (or Europe) - then yes it does! The GDPR applies to ‘controllers’ and ‘processors’. The definitions are broadly the same as under the DPA – ie the controller says how and why personal data is processed and the processor acts on the controller’s behalf. If you are currently subject to the DPA, it is likely that you will also be subject to the GDPR.
What do I now need to worry about?
People are going to gain lots of 'data rights' - such as the right to be forgotten, informed, to access, to restrict processing and to object. In addition, you're going to need to be able to demonstrate full consent to hold and use data and you're going to need to show that you have acted upon the 'data right's listed above. In other words - accountability and governance can no longer be afterthoughts.
